These Terms of Use (“Terms”) govern your access to, and use of, our Website and Learning Portal (“Platform”). We provide online and offline events/experiences/edutainment memberships/subscriptions/courses (“Service” or “Services”)

By using our Services, you agree to these Terms. If you do not agree, please do not use our Platform. 

1. Other Definitions

  • Company refers to Creator Mums Internet Content Provider, a UAE-registered entity owned by sole proprietor Abha Malpani Naismith, with license number 1084682. Contact us at [email protected].
  • Personal Data refers to any information that identifies or can identify you, including your name, email, location, and other personal details.
  • Platform refers to the website www.abhamalpaninaismith.com and its associated Learning Portal, https://learn.abhamalpaninaismith.com/, hosted by a third party called Kajabi.
  • Customer: refers to a person who has paid for a Service which gives access to Customer only content on our Platform
  • User Account refers to the registered profile created to access our digital content and services.
  • Third-Party Sites include external platforms we use to provide our services (e.g., Kajabi, Zoom, Google, ManyChat, Squarespace, etc.).
  • Visitor refers to anyone browsing our website without registering.
  • Subscriber refers to anyone who has registered their email on our Portal; they may or may not have paid
  • You/Your refers to all users, whether customers, subscribers or visitors. 

2. Your Consent

By accessing our Platform, you confirm that you are at least eighteen (18) years old and legally capable of entering a contract. If you do not agree to these Terms, please discontinue using our Services.

3. Access to the Platform

Depending on what Service you have paid or registered for, you are granted limited, non-exclusive, and non-transferable rights to:

  • Access and use our Platform  for personal and business-related content consumption.
  • Download and utilize provided content within the scope of your learning experience.

What you are NOT allowed to do:

  • Modify or copy content without written permission.
  • Use bots, data mining, or other automated tools that are not associated with the Platform.
  • Spread malware, viruses, or any harmful technology.
  • Post unlawful, offensive, defamatory, or inappropriate content.
  • Take screenshots of Platform content and share them without permission.
  • Reproduce, resell, or distribute any content for commercial purposes without prior consent.

We reserve the right to terminate User Accounts violating these Terms, without notice.

4. User Account and Responsibilities

  • You are responsible for providing accurate registration details.
  • You agree to receive emails about events, updates, and resources.
  • You may opt out of communications by “unsubscribing” from an email you receive or updating you preferences on that email you have received. This may affect notifications about services. 
  • Your account is personal and non-transferable unless.
  • You may not use our Platform to distribute spam, malware, or inappropriate content.

5. Features of the Learning Portal

Our Platform offers:

  • Events (both virtual and in-person) for Customers,Subscribers and Visitors
  • Free Business Resources such as guides, checklists, and templates (available upon registration).
  • Community Access where Customers connect, share insights, and participate in discussions.
  • Communication Tools that allow Customers and Subscribers users to interact within our guidelines.

We moderate interactions but do not guarantee the security of shared messages. Customers,Subscribers and Visitors assume all risks associated with participation.

6. Payments & Refunds

  • Payments can be made via Stripe or PayPal.
  • All transactions are final. 
    • If communicated as per the promise of the particular Service you bought and / OR
    • In accordance with UAE Consumer Protection Law No. 24 of 2006 and its amendments, particularly in cases of defective or non-conforming service
    • Refunds will be provided only:
  • Payment plans must be honored; failure to do so will result in account suspension and claims for outstanding balances.
  • Additional fees imposed by banks for international transactions are not our responsibility.

7. Community Guidelines

We reserve the right to update our Community Guidelines at any time. 

Unacceptable behavior includes:

  • Harassment, hate speech, or abusive language.
  • Sharing false or misleading information.
  • Soliciting members for sales or unrelated promotions

We may cancel the user account of and deny access to any individual or business Customer/Subscriber that violates these Community Guidelines.

8. Online Communications & Content Moderation

We communicate via emails, notifications, and community messages. We may remove any content that:

  • Violates our Terms.
  • Contains offensive, harmful, or illegal material.
  • Disrupts the learning environment.

9. Limitation of Liability

We provide our Services and content for educational and informational purposes only. We do not guarantee results and are not liable for any direct or indirect damages arising from the use of our Services.

10. Intellectual Property

  • All Platform content is owned by the Company or licensed for use by The Company
  • Unauthorized use, reproduction, or distribution of our content is prohibited.

11. Third-Party Sites

We may include links to external websites. We are not responsible for the content or privacy practices of these third parties. Users should review their terms before engaging with them.

12. Amendments & Updates

We may modify these Terms at any time. The latest version will always be available on our website. Continued use of our services indicates acceptance of updated terms.

13. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of the United Arab Emirates.
  • Disputes will be resolved first and foremost by a jointly appointed mediator from Islamic Arbitration and Mediation Services LLC
  • If still unresolved, Claims regarding payment defaults may be referred to the Dubai International Financial Centre (DIFC) Small Claims Tribunal.

14. Termination

We reserve the right to terminate Customer, Subscriber or Visitor access at any time without notice. Customers may request termination of their accounts by notifying us in writing at [email protected], with at least 2 weeks notice.
